Schools have a duty to provide an appropriate education to implement necessary accommodations for a student or child with a disability or special needs. Once a child is identified as having a special need, the school must make necessary accommodations in their facilities and in the classroom. Your Rights Relating to Special Needs Accommodations

A child is usually identified as special needs by an evaluator either at the school, or an independent evaluator at the parent's request. Once a child has been identified as having special needs, we work with parents, teachers and experts to put an Individualized Education Plan (IEP) together. This takes into account the accommodations the school must make for the child. Often we become involved if a plan has been made, but has not been followed by the child's school, or if a plan needs to be created and put in place for the child.

Special accommodations may include:

  • Special classes
  • Having an aide assigned to the child during school hours
  • Bathroom facility accommodations
  • Transportation

Special needs cases involve children with:

  • Autism
  • Diabetes
  • Downs syndrome
  • ADD (attention deficit disorder)
  • ADHD (attention deficit hyperactivity disorder)
  • Depression or anxiety

For Children Not Yet Identified as Special Needs

If your child is not yet identified as having a disability or special needs, you may still have rights that need to be protected if your child has become a target of discrimination or unfair disciplinary practices. We know that learning disabilities and other behavioral conditions can affect a child's ability to perform in school. It is important to seek an evaluation to ensure that your child is given an appropriate education and accommodations at school. Without a special needs assessment, your child could continue to face unjust disciplinary actions and discrimination.

Administrative Meetings Involving an IEP

We represent clients in all administrative proceedings involving the development and implementation of an IEP. This includes seeking modification or enforcement of a plan. If the school is not following a plan or the plan is not being executed because of budgetary constraints, you may need a legal advocate who can ensure that your child's special needs and rights are met. We will work with school administrators to reach an appropriate resolution as soon as possible. In the event that we cannot resolve matters through administrative channels, we are prepared to file a complaint against the school system for violating your child's disability rights.
